U.S. Legal-Capacity Affidavit for a Philippine Wedding

The United States does not issue a national certificate declaring that an individual is free to marry. Confirm the Philippine office’s accepted affidavit procedure.

Ask about the exact instrument

When the registrar asks for a certificate of legal capacity, explain that you are a U.S. citizen. Ask which affidavit in lieu it will accept, who must witness the signature, and what supporting records you must present. Request instructions for your own municipality and intended filing date.

Arrange the signature in the right order

Do not sign a blank form in advance of an appointment that requires a witnessed signature. Check the procedure with the office performing the service. Keep a copy of its instructions with the registrar’s reply so you can see if the two offices mean the same document.

Know what the affidavit accomplishes

The affidavit concerns your statement of eligibility. It does not issue a marriage license, resolve a previous marriage or reserve a ceremony. If the office questions a foreign decree or identity detail, address that separate issue before building a holiday around the wedding date.

Before your next appointment

  • Name of the accepted affidavit
  • Person or office authorized to witness it
  • Supporting originals and appointment arrangements
